GENERAL TERMS AND CONDITIONS OF SALE (GTCS) OF THE WEBSITE OF SASU HOW WE RENT

 

Preamble

These General Terms and Conditions of Sale (GTCS) apply to all services offered by SASU HOW WE RENT, a simplified joint-stock company with a single shareholder, with a share capital of €1,000, whose registered office is located at 132 Corniche Fleurie, 06200 Nice, registered with the Trade and Companies Register for a duration of 99 years from the date of registration. The company is represented by its President, Ms. Audrey Carol Johanna CHAZALETTE, born on June 29, 1989, in Nîmes, of French nationality, single, residing at the registered office.

 

These GTCS govern the sale of services provided via the website of SASU HOW WE RENT to individual or professional clients, subject to express and prior acceptance of these terms at the time of each order.

 

 

Article 1 – Purpose

These GTCS define the terms and conditions applicable to all services offered by SASU HOW WE RENT, including consulting, support, auditing, optimization, and management of real estate or hospitality projects, online valorization, and coaching services, excluding regulated or therapeutic activities.

 

 

Article 2 – Services Offered

SASU HOW WE RENT’s services are structured around the following main categories:

 

Support for New Investors

 

  • Profitability projections & business plan

  • Property audit

  • Renovation budget & home staging

  • Coordination of service providers

  • Listing & revenue management

  • Coaching

  • Revenue and expense forecasting, property selection, initial valuation, organization of works, marketing optimization, personalized support

 

 

Audit and Optimization for Experienced Investors or Hoteliers

 

  • Comprehensive operations audit

  • Performance analysis (occupancy rate, RevPAR, ADR, client feedback)

  • Process optimization

  • Team coaching

  • Personalized strategy

  • Diagnostics of existing operations, recommendations for efficiency improvement, training, profitability and performance strategies

 

 

Distribution Management and Online Valorization

 

  • Publication & visibility (websites, search engines, social media)

  • Dynamic revenue management

  • Production of engaging content (photos, home staging, descriptions)

  • Monitoring & optimization

  • Platform visibility improvement

  • Real-time pricing adjustments

  • Continuous online performance improvement

 

 

Specific details of each service will be specified at the time of contracting, through an accepted and signed quotation.

 

 

Article 3 – Orders

Any order requires validation of a quotation or contract specifying the terms, price, and detailed description of the service.

The company reserves the right to refuse or cancel any order that does not correspond to its corporate purpose or falls outside the legal framework applicable to SASUs.

 

 

Article 4 – Prices and Payment Terms

Applicable prices are those indicated at the time of order, expressed in euros, all taxes included. Price details are available upon request or in the quotation. Unless otherwise specified, payment is due upon ordering, by bank transfer or any payment method accepted by SASU HOW WE RENT. For recurring services or subscriptions, specific payment terms are stipulated in the contract.

 

 

Article 5 – Service Execution

The company undertakes to perform the service or ensure proper delivery according to the agreed terms and schedule. Any modification of the contractual scope must be agreed upon in writing. The company reserves the right, in case of unforeseen difficulties or force majeure, to modify the date or content of the service after informing the client.

 

 

Article 6 – Client Obligations

The client undertakes to provide all information deemed necessary for proper service execution. The client remains responsible for the accuracy and completeness of all documents, data, and materials provided to the company.

 

 

Article 7 – Company Obligations and Responsibilities

 

  • Obligation of means, not result, in performing services

  • Strict separation between consulting services and any regulated real estate intermediation activity, in accordance with the company’s statutes

  • Confidentiality of client information

  • Services performed in accordance with Article 1833 of the French Civil Code and in the client’s best interest

 

 

 

Article 8 – Liability

SASU HOW WE RENT is bound by an obligation of means in performing its services. Liability can only be engaged for direct, certain, and proven damage resulting from a breach of contractual obligations, excluding any indirect or immaterial damage.

 

 

Article 9 – Intellectual Property

All elements, documents, reports, plans, studies, editorial or visual content produced as part of the services remain the exclusive property of SASU HOW WE RENT, unless otherwise specified. Unless expressly agreed, the client is only authorized for personal and internal use.

 

 

Article 10 – Confidentiality

Each party undertakes to preserve the confidentiality of all information and documents exchanged during the provision of services, except in case of legal obligation or prior written consent.

 

 

Article 11 – Personal Data

Personal data collected during the order process and/or service execution are processed in accordance with the company’s privacy policy and applicable regulations.

 

 

Article 12 – Right of Withdrawal (Consumer Clients)

Under the law, consumer clients have a 14-day withdrawal period from the signing of the contract, except if the service begins at the client’s express request before the end of the withdrawal period.

 

 

Article 13 – Service Delivery / Execution

Services are provided within the timeframes specified in the quotation/contract. A schedule may be established at the time of order.

 

 

Article 14 – Duration and Termination

Each service is provided for the duration specified in the contract. Any early termination, by either party, must comply with the terms stipulated in the offer or contract, in addition to applicable legal obligations.

 

 

Article 15 – Governing Law and Jurisdiction

These GTCS are governed by French law. In the absence of an amicable agreement, any dispute regarding their interpretation or execution shall fall under the exclusive jurisdiction of the courts of the registered office of SASU HOW WE RENT.

 

 

Article 16 – Insurance and Authorizations

As noted in the statutes: services falling under regulated professions are reserved for authorized professionals; real estate intermediation services will not be provided by the company.
